CONSIDERATION OF A RESOLUTION AWARDING A MAINTENANCE SERVICES CONTRACT TO BPR, INC. FOR THE SIDEWALK REPAIR AND MAINTENANCE SERVICES, CIP PROJECT NO. 27311, IN AN AMOUNT NOT TO EXCEED $220,000, AUTHORIZING THE CITY MANAGER TO EXECUTE THE CONTRACT, AND FINDING THE PROJECT CATEGORICALLY EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT

Summary:
The City Council is being asked to consider adoption of a Resolution (Attachment 1) to award and authorize the execution of a one-year Maintenance Services Contract with BPR Inc., in an amount not to exceed $220,000, for Sidewalk Repair and Maintenance Services (Attachment 2).
Background:
The City of San Clemente maintains over 150 miles of concrete sidewalks. Sidewalk repair and assessment services are essential for complying with ADA requirements and protecting pedestrians. In the previous fiscal year Sidewalk Maintenance Services project, 60.68 miles of inspection and 2,161 locations of trip hazard repairs were completed with $200,000 in funding.
Sidewalk Repair and Maintenance Services include removing up to 2 inches of vertical displacement in sidewalks to maintain 1:12 slopes and meet ADA guidelines, and providing GIS data that integrates with the City’s GIS system to record repairs for future sidewalk maintenance needs.

Discussion:
City staff prepared a Request for Proposals (RFP) for a Sidewalk Repair and Maintenance project, researched potential local contractors, and solicited proposals on PlanetBids. On May 7th, 2026, the City received four proposals from qualified professionals: BPR, Inc., Universal Concrete Grinding, LLC, Southern California Precision Concrete Inc. dba Precision Concrete Cutting, and Greek Concrete, Inc. Greek Concrete, Inc. failed to submit their proposal in accordance with the RFP; therefore, Greek Concrete, Inc. was deemed non-responsive.
The three remaining proposals were evaluated by City staff with knowledge of sidewalk trip-hazard removal procedures and a data collection system compatible with the City’s GIS, in accordance with the City’s Procurement Policy and Procedure, Section IX, SELECTION OF GENERAL SERVICE CONSULTANTS AND CONTRACTORS. Universal Concrete Grinding proposed the lowest unit cost; however, their approach and methodology, environmental considerations such as dust containment, work plan, project lead organization, and staffing led them to a low ranking under the RFP ranking criteria. BPR, Inc. and Precision Concrete Cutting proposals both demonstrated experience and qualifications satisfactory to the City’s needs based on overall responsiveness to the criteria provided in the RFP. Staff recommends BPR, Inc. as the qualified and competent professional sidewalk maintenance services contractor, consistent with the qualities and services the City of San Clemente is seeking, at a fair and reasonable price.

As required by state law and City policy, BPR Inc. must provide performance and payment bonds upon execution of the construction contract (Attachment 2).
Considerations Identified by Staff:
By awarding a Sidewalk Maintenance Services Contract to BPR Inc., the contractor will provide professional trip-hazard remediation, inspection, and documentation to detect potential trip hazards and protect pedestrians.
If the City chooses not to award sidewalk maintenance services, vertical displacement on the sidewalk will progress, and trip hazards will increase, leading to the full replacement of the sidewalk at higher costs and an increased risk to pedestrians.
Council Options:
• Adopt Resolution No. 26-129 (Attachment 1), awarding the Sidewalk Repair and Maintenance Services contract to BPR, Inc., authorizing the City Manager to execute a construction contract in an amount not to exceed $220,000, and finding the project categorically exempt from the California Environmental Quality Act (CEQA) under Class 1 (Existing Facilities, 14 CCR section 15301) of the State CEQA Guidelines.
• Modify and adopt Resolution No. 26-129.
• Continue the item and direct staff to provide additional information.
• Do not award the Sidewalk Maintenance Services Contract to BPR, Inc. for the Sidewalk Repair and Maintenance Services project and provide staff with specific direction regarding alternative sidewalk maintenance.
Environmental Review/Analysis:
This project is exempt from the California Environmental Quality Act (CEQA) under Class 1 (Existing Facilities, 14 CCR section 15301) of the State CEQA Guidelines because it consists of maintenance to existing City facilities, involves negligible or no expansion of existing or former use, and has no possibility of a direct or reasonably foreseeable indirect effect on the environment.
Fiscal Impact:
The total Sidewalk Maintenance Services Contract cost is $220,000, which is within the approved Sidewalk Maintenance Services budget from the General Fund, $150,000 from Account No. 001-416-45710-000-27311 and $95,000 from Account No. 001-416-45710-000-26305.
