CONSIDERATION OF A RESOLUTION AWARDING A CONSTRUCTION CONTRACT TO JUDGE NETTING, INC. FOR THE DRIVING RANGE ERRANT BALL NETTING EXTENSION, CIP PROJECT NO. 13607, IN AN AMOUNT NOT TO EXCEED $313,200, AUTHORIZING THE CITY MANAGER TO EXECUTE THE CONSTRUCTION CONTRACT WITH JUDGE NETTING, INC., AND FINDING THE PROJECT CATEGORICALLY EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT

Summary:
The City Council is being asked to consider adoption of a Resolution (Attachment 1) awarding a construction contract to Judge Netting, Inc., in an amount not to exceed $313,200 (Attachment 2), for the replacement of the west side of the Driving Range Errant Ball Netting to increase the capture of golf balls straying from the Golf Course and Driving Range.
Background:
The driving range net height along the 6th hole (behind houses on Calle Del Comercio) of the Municipal Golf Course is proposed to be raised from its existing height of approximately 30 and 60 feet to 70 feet to reduce the number of errant golf balls leaving the range and entering the adjacent sixth fairway of the golf course. Conversely, miss hit golf balls from the sixth fairway can enter the driving range. The project entails replacing the existing 30 feet steel poles with fully treated wooden poles standing 70 feet above ground and installing 10-foot steel pole extensions on four of the existing 60 feet wooden poles on the southwest side of the range to improve safety.
A vertical extension to the driving range net will decrease errant shots from entering and exiting the driving range. This proactive step will enhance the overall experience at the municipal golf facility. On August 28, 2025, the Golf Course Committee reviewed the proposed changes to the netting height and recommends City Council approval of the project. A location map is provided in Attachment 3.
Discussion:
City staff prepared a bid package for the Driving Range Errant Ball Netting project, notified local contractors, and advertised the project on the PlanetBids website and in the SC Times newspaper. Two bids were received on April 17, 2026, ranging from $230,000 to $310,700 for the Base Bid only, and from $234,500 to $313,200 for the Base Bid and Alternate Bids (See Table 1 below).
The apparent lowest bid for the Base Bid of $230,000 was received from West Coast Netting, Inc. of Kingman, Arizona. However, the contractor failed to fulfill the bid submission requirements. The only document the contractor submitted electronically via the City's PlanetBids system was the bid security. West Coast Netting, Inc. failed to attach scanned copies of the printed Bid Forms and a signed copy of Addendum No. 1, which is mandated by the project specification. In particular, Addendum No. 1 contained important information (i.e., revised scope of work) affecting the proposed bid amount. Due to these irregularities and material deviations, staff recommends the City Council reject West Coast Netting, Inc.’s bid as defective and non-responsive.
A city generally has the discretion to determine bid responsiveness and may either demand strict compliance with the bid specifications or choose to waive a defect that is inconsequential or is an immaterial deviation. See Taylor Bus Serv., Inc. v. San Diego Bd. of Educ. (1987) 195 Cal.App.3d 1331, 1343.

The lowest responsive and responsible bidder was Judge Netting, Inc. of Costa Mesa, California, with a total bid amount of $313,200. Based on the lowest Base Bid and Alternate Bid (potential cart path repair if needed), the total estimated project construction cost is summarized in Table 2. Cost Summary below:

As required by state law and City policy, Judge Netting, Inc. must provide performance and payment bonds upon execution of the construction contract (Attachment 2). Project plans and specifications are on file in the City Clerk’s office.
Considerations Identified by Staff:
Increasing the height of the netting will improve containment of errant golf balls, enhance player safety, and improve the overall golfing experience at the municipal golf facility. While the project will require additional construction and maintenance costs, the proposed improvements represent a proactive investment in improving the golf course and customer experience. If the driving range netting is not extended, errant golf balls will continue to enter adjacent areas of the golf course, including the 6th fairway and driving range, which has been a common complaint from the Golf Course Committee and golf patrons.
Council Options:
• Adopt Resolution No. 26-140 (Attachment 1), awarding a construction contract to Judge Netting, Inc. for construction of Driving Range Errant Ball Netting Extension, finding the project categorically exempt from the California Environmental Quality Act (CEQA) under Section 15301, Class 1 (Existing Facilities) and Section 15302, Class 2 (Replacement or Reconstruction) of the state CEQA Guidelines, and authorizing the City Manager to execute a construction contract in an amount not to exceed $313,200.
• Modify and adopt Resolution No. 26-140 for the Driving Range Errant Ball Netting Extension project.
• Continue the item and direct staff to provide additional information.
• Do not adopt Resolution No. 26-140 and put the project on hold.
Environmental Review/Analysis:
This project is categorically exempt from the California Environmental Quality Act (CEQA) under Section 15301 Class 1 (Existing Facilities) and Section 15302 Class 2 (Replacement or Reconstruction), since it consists of replacement of existing poles where the new poles will be located on the same site and will have substantially the same purpose and capacity, and the project is consistent with the applicable general plan designation and all applicable general plan policies as well as with applicable zoning designation and regulations.
Fiscal Impact:
The total estimated construction cost is $313,200, which is within the approved Driving Range Errant Ball Netting Extension budget from the Golf Course Fund, Account No. 056-667-45300-000-13607.

4. Authorize the City Manager to execute a construction contract with Judge Netting, Inc. in the amount of $313,200 for the Driving Range Errant Ball Netting Extension.
